California Court Reinstates Elder Abuse Claims In Negligence Suit

SACRAMENTO, Calif. - The Third District California Court of Appeal on March 28 reversed a trial court ruling sustaining a demurrer in an elder abuse and wrongful death cause of action against a long-term care facility. The appeals court reinstated the elder abuse claims against the facility but affirmed the summary judgment dismissing the wrongful death claims, saying these claims were filed outside the one-year statute of limitations for cases involving professional liability (Dennis Haney v. Eskaton Properties Inc., No. C063376, Calif. App., 3rd Dist.; 2011 Cal. App. Unpub. LEXIS 2274). Full story on lexis.com
