SPRINGFIELD, Ill. – Punitive damages based on “willful and wanton violation” of the Illinois Nursing Home Care Act are not available if the nursing home resident who allegedly was injured by those violations has died, the state Supreme Court held March 24 (Thomas Vincent v. Alden-Park Strathmoor Inc., No. 110406, Ill. Sup.; 2011 Ill. LEXIS 451; See May 2010, Page 14).
