MINEOLA, NY – A New York trial court on May 5 granted a nursing facility summary judgment in a resident’s rights state cause of action, saying the facility presented prima facie evidence that it did not breach the standard of care and did not fail to provide the plaintiff resident adequate and appropriate care for pressure ulcers, cellulitis and management of her anti-seizure medication (Teresa Rea, et al. v. Rockville Nursing Center Inc., No. 12862/09, N.Y. Sup., Nassau Co.; 2011 N.Y. Misc. LEXIS 2324).
