BUFFALO, NY – A New York trial court justice on April 11 upheld a $600,000 verdict in a nursing home negligence cause of action, saying the weight of the evidence supported the jury’s finding. Erie County Supreme Court Justice John M. Curran concluded that the defendant nursing facility failed to object to the admission of evidence at trial, thus failing to preserve the issues for appeal (Kathleen P. Mueller, et al. v. Elderwood Health Care at Oakwood, et al., No. 12008-1416, N.Y. Sup., Erie Co.; 2011 N.Y. Misc. LEXIS 1498).
