OKLAHOMA CITY – The Oklahoma Court of Civil Appeals, Division Four, on May 5 affirmed a $175,000 verdict against an Oklahoma Department of Veterans’ Affairs nursing facility. The appeals court, however, modified the judgment to overturn an alternative theory of statutory negligence, saying the plaintiff lacked standing to bring claims under the VA regulations delineating the standards applicable to nursing homes (Lula Lounds, et al. v. State of Oklahoma ex rel. Department of Veterans Affairs, No. 107665, Okla. App., Div. 4; 2011 Okla. Civ. App. LEXIS 27).
