KNOXVILLE, Tenn. – U.S. Judge Thomas A. Varlan of the Eastern District of Tennessee on July 15 dismissed with prejudice a Tennessee Medical Malpractice Act (TMMA) cause of action against Summit View of Farragut, a nursing facility. The plaintiff failed to comply with the notice and expert witness requirements in the state’s medical malpractice law, Judge Varlan said (Robin Southwell v. Summit View of Farragut, No. 3:10cv550, E.D. Tenn.; 2011 U.S. Dist. LEXIS 77145).
