Huguely attorneys seek change of venue in wrongful death lawsuit
CHARLOTTESVILLE, Va. –Attorneys representing convicted murderer George W. Huguely V in a wrongful-death suit filed a response to the suit Wednesday in Charlottesville Circuit Court, saying the suit does not present enough factual evidence to support its claims.
James W. Morris III, Matthew D. Green and Melissa Y. York, the Richmond-based attorneys who will represent Huguely in the civil matter, also filed a motion to transfer the venue of the civil trial outside of Charlottesville.
The filings question the “legal sufficiency of the facts alleged” in Sharon Love’s $ 30 million wrongful death lawsuit against Huguely.
Love is the mother of Yeardley Love, whom Huguely was convicted of killing.
In her suit, filed April 26, Love claimed that Huguely failed to use ordinary care, acted with indifference and utter disregard of caution and with a conscious disregard and reckless indifference when he left Yeardley Love alone in her apartment after a physical altercation early on May 3, 2010. Love was found dead in her apartment just hours later.
The newly filed objection says that Sharon Love’s allegations “merely recite the elements of those categories of negligence and state conclusions of law.”
Moreover, new court documents say that “the only facts alleged in the complaint, that defendant entered Love’s apartment and engaged in a physical altercation, which resulted in Love’s injuries and death … do not rise to the level of gross negligence and/or reckless or willful and wanton conduct.”
The filing also says that the wrongful-death suit stated no facts in support of its allegations of assault and battery.
