Family of New York file wrongful death suit

HONOLULU –  The family of a New York teen swept out to sea while hiking in Hawaii filed a wrongful death lawsuit Tuesday, claiming tour guides were negligent for leading a group of teenagers to dangerous area.
Tyler Madoff’s body has not been found since the 15-year-old was swept off the west coast of the Big Island during a kayak expedition on July 4. The White Plains teen is presumed dead.
The death of Tyler, a Scarsdale High School student, was caused by the tour guides’ “outrageously reckless and irresponsible decision” to lead the group from the “safety of the bay to the treacherous lava rock area,” according to the lawsuit filed in federal court in Honolulu.
They were hiking near the Captain Cook monument at Kealakekua Bay when they stopped to rest at a tide pool, authorities said. The teens were led to an area that’s out of a state permitted area despite dangerous surf warnings, according to the suit.
“Some of the teenagers scrambled for cover and attempted to grab on to anything to keep them from being swept back out of the tidal pools into the ocean by the violently receding waves,” according to the lawsuit. “Tyler was last seen being swept through the tide pool by the raging waters and over the shore line cliffs into the ocean, never to be seen again.”
The family also claimed that the group team leader did nothing to help Tyler. The lawsuit said the man has a criminal history including disorderly conduct and marijuana possession, even though Colorado-based Bold Earth Teen Adventures claims its leaders undergo background checks.

National Plavix Lawyers File Wrongful Death Lawsuits on Behalf

Parker Waichman LLP has filed three lawsuits on behalf of the estates of victims who suffered fatal gastrointestinal and/or cerebral hemorrhaging allegedly due to the blood thinner, Plavix.

Parker Waichman LLP, a national law firm dedicated to protecting the rights of victims injured by defective drugs, has filed lawsuits alleging Bristol-Myers Squibb and Sanofi-Aventis’ Plavix caused the wrongful deaths of three patients. The suits were filed on May 30th in the Supreme Court of New York, County of New York.

One of the complaints, filed on behalf of the estate of a Rapides, Louisiana man, states that the Plaintiff-Decedent started taking Plavix in 2002 and died after a cerebral hemorrhage last June (Case No. 2017532). Another suit was filed on behalf of an Ottowa, Michigan man who began taking Plavix in July 2008 (Case No. 1043498); the Plaintiff-Decedent died in June 2009, after suffering from two gastrointestinal hemorrhages and one cerebral hemorrhage. The third suit was filed on behalf of a Bexar, Texas man and alleges that Plavix caused a gastrointestinal hemorrhage in June 2010 as well as his subsequent death that August (Case No. 1054631). All three complaints allege severe and permanent injuries, physical impairment and disfigurement, physical pain and suffering, mental pain and suffering, loss of enjoyment of life and medical expenses related to the Plaintiff-decedent’s injuries.

The lawsuits allege that the Defendants did not properly test Plavix for safety or effectiveness, exposing users to an increased risk of heart attack, stroke, blood disorders and excessive bleeding.
